Lake Mountain Winter Portrait Activation

Participant Waiver, Terms & Operational Information

By participating in the Lake Mountain Winter Portrait Activation provided by Kelly Hoinville Photography, you acknowledge and agree to the following:

1. Voluntary Participation

Participation in this photography activation is voluntary. By taking part, you consent to having photographs captured of yourself and any minors in your care.

Participants confirm they are:

  • Over 18 years of age, OR

  • A parent/legal guardian providing consent for minors

2. Alpine Environment & Weather Conditions

This photography activation takes place in an alpine snow environment at Lake Mountain. Participants acknowledge:

  • Snow, ice, and uneven terrain may be present

  • Weather conditions may change rapidly

  • Cold temperatures and wind exposure may occur

  • Participants are responsible for appropriate clothing and footwear

  • Participation is at the individual’s own risk

Kelly Hoinville Photography accepts no responsibility for:

  • Slips or falls

  • Weather-related discomfort

  • Injuries resulting from alpine conditions

  • Environmental hazards outside photographer control

3. Complimentary Portrait Activation

  • Portraits are captured free of charge

  • Images may be purchased via online gallery once they have been delivered to participants

  • Participation does not guarantee image purchase

  • A limited number of images (maximum 5) may be captured per group

  • Images are captured quickly to manage high visitor volumes

  • Specific poses or image requests cannot be guaranteed

4. Queue & Capacity Management

Due to high visitor volumes:

  • Wait times may occur

  • Participation is not guaranteed

  • The activation may close once daily capacity is reached

  • Sessions may pause due to safety or operational requirements

5. Email Collection & Communication

Participants provide their email address for:

  • Gallery delivery

  • Notification when images are ready

  • Activation-related communication

Participants will receive:

  • Email 1: Thank you and important information

  • Email 2: Gallery link (typically within 48 hours)

  • Email 3: Gallery closing, final chance to purchase images

6. Shared Daily Gallery

Participants acknowledge:

  • Images will be delivered in a shared daily gallery

  • Other guests photographed on the same day will appear in the gallery

  • Participants will select and purchase only their own images

  • Kelly Hoinville Photography cannot guarantee private gallery delivery for this activation

7. Creative Discretion

Participants acknowledge:

  • Images are captured and edited in the Photographer’s artistic style

  • Final image selection is at Photographer discretion

  • Unedited images will not be provided

  • Final images will contain Lake Mountain Logo

8. Copyright & Usage

All images remain copyright of Kelly Hoinville Photography.

Purchased images:

  • Licensed for personal use only

  • May be shared on social media

  • Cannot be used commercially without written permission

9. Model Release & Promotional Use

By participating, you grant permission for Kelly Hoinville Photography to:

  • Use images for marketing and promotional purposes

  • Use images on website and social media

  • Use images in advertising and publications

  • Use images to promote Lake Mountain tourism and visitor experience

No compensation is provided for promotional use.

10. Child Supervision

Parents and guardians remain responsible for supervising children at all times.

11. Behaviour & Safety

Kelly Hoinville Photography reserves the right to:

  • Decline participation

  • Cease operation

  • Remove participants behaving unsafely or inappropriately

12. Weather & Operational Changes

Operations may pause or stop due to:

  • Severe weather

  • Safety concerns

  • Operational requirements

  • Direction from Lake Mountain staff

13. Limitation of Liability

While reasonable care is taken:

  • Images may be affected by technical failure or unforeseen circumstances

  • Participation is voluntary and at participant risk

  • Liability is limited to the complimentary nature of the activation

14. Privacy

Email addresses will:

  • Not be sold or shared with third parties

  • Be stored securely
